These Terms of Service (“Terms”) govern your use of purelandscapedesign.com (the “Website”) and your communications with Pure Landscape Design Inc., doing business as Pure Masonry & Landscape Contractors (“Pure,” “we,” “us,” or “our”), including forms, calls, emails, and text messages. By using the Website or submitting your information to us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.

1. About Our Services
Pure provides landscape design and installation, planting design, patios, retaining walls, masonry, walkways, steps and stoops, decks, outdoor living spaces, multisport and pickleball courts, drainage and grading, land clearing and excavation, lawn, estate, and property maintenance, and commercial snow removal for residential, commercial, and HOA properties on Long Island’s North Shore and surrounding areas.
Service availability depends on location, season, scheduling, and project scope. Listing a service on the Website does not guarantee we can accept every project.
2. Website Information Is Not an Offer
Content on the Website, including service descriptions, photos, blog articles, and project examples, is provided for general information. It is not an offer, a quote, or a guarantee of pricing, results, timelines, or availability.
Blog posts and design tips are general guidance only. They are not engineering, architectural, surveying, or legal advice for your specific property. Site conditions, soil, drainage, permits, and local regulations vary.
Project photos show examples of our work and may include design choices, materials, or conditions that differ from your project.
3. Estimates and Consultations
Estimates are based on the information available at the time, including site conditions we can observe. Unless stated otherwise in writing:

- Final pricing may change because of hidden site conditions, material price changes, design changes, permit requirements, or changes you request
4. Project Agreements
All installation, construction, and home improvement work is performed under a separate written agreement signed by you and Pure. That agreement will describe the scope of work, price, payment schedule, deposit terms, estimated timeline, and your cancellation rights under New York law.
If anything in these Terms conflicts with your signed project agreement, your signed project agreement controls.
Maintenance programs and commercial or HOA snow removal services are also governed by their own written service agreements.
5. Permits, Property Lines, and Utilities
Unless your written agreement says otherwise:
- You are responsible for providing accurate information about property lines, easements, HOA rules, and any known underground features such as irrigation, septic systems, drywells, or private utility lines
- Required permits and approvals will be addressed in your project agreement
- Public utilities will be marked through New York’s 81 1 call-before-you-dig process before excavation where required
6. Text Messaging (SMS) Terms
Program: Pure Masonry & Landscape Contractors customer and marketing messages.
By checking the text message consent box on our forms or otherwise giving us your mobile number with consent, you agree to receive text messages from Pure at the number you provided. Messages may include responses to your inquiry, estimate and appointment reminders, project and service updates, review requests, and, if you opted in to marketing, seasonal offers and promotions. By providing your phone number, you agree that Pure may call you about your inquiry, estimate, or project. Calls may be monitored or recorded for quality, training, and tracking purposes where permitted by law.

Landscape designs, drawings, and plans prepared by Pure remain Pure’s property unless your written agreement states otherwise.
11 . Reviews, Photos, and Submissions
If you submit a review, testimonial, photo, or other content to us, you give Pure permission to use, display, and share it on the Website, social media, and marketing materials. We may display your first name and last initial with a testimonial. We will not publish your full name or street address without your permission. You confirm that anything you submit is truthful and that you have the right to share it.
12. Third-Party Links and Services
The Website may link to or use third-party services, including Google, Facebook, Instagram, review platforms, scheduling tools, and payment processors. We are not responsible for their content, policies, or practices. Your use of those services is subject to their terms.

TO THE FULLEST EXTENT PERMITTED BY LAW, PURE AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE OR RELIANCE ON ITS CONTENT.
This section applies to your use of the Website. Liability for project work is governed by your signed project agreement and applicable New York law.
15. Indemnification
You agree to indemnify and hold harmless Pure and its owners, employees, and contractors from any claims, losses, or expenses, including reasonable attorneys’ fees, arising from your misuse of the Website, your violation of these Terms, or content you submit to us.
16. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute related to these Terms or the Website will be brought in the state or federal courts located in Suffolk County, New York, and you consent to the jurisdiction of those courts.
17. Changes to These Terms
We may update these Terms from time to time. Updates will be posted on this page with a new “Last Updated” date. Your continued use of the Website after changes are posted means you accept the updated Terms.

If any part of these Terms is found unenforceable, the remaining sections will stay in full effect.
